Research On The Purchase Of Service Under The Perspective Of Economic Law

Based on the theoretical analysis under the perspective of economic law, the paper tries to doa comprehensive and deep study on the regulations on Purchase of Service to economic law. Themain content of this paper will focus on the theory and practice of economic law, deficiency andperfection of the economic law on the Purchase of Services.The first part is an overview of the contents of Purchase Service, which contains two parts.First, the paper has a wide range of visits to Purchase of Services, and tries to complete the basicdefinition by three aspects: the description in the field of public administration, differentiate andanalysis of the Purchase of Service and the Government Procurement, and the basic elements ofPurchase of Services. Second, the paper does the analysis on the Purchase of Services under theperspective of economic law, mainly to summarize the definition under the perspective ofeconomic law, and explore the relationship among the government, the service provider and theservice recipient in the level of economic law.The second part is the theoretical analysis of purchase of service under the perspective ofeconomic law. This section starts from the fit of the theoretical basis of the purchase of service andthe economic law theory, which is the core content. First, the paper analyses the rationality of thepurchase of service, through the theoretical basis of the service system which contains the publicmanagement theory, the theory of social governance and the service-oriented government theory.Second, the paper explores the theoretical value of purchase of service in the view of economic law,through the macro regulation, market regulation and value orientation of the development of thewhole society.In the third part, the paper does a survey to the domestic practice of the purchase of services.This part does an analysis of economic law in practice, which is the focus of this study. First, thepaper concludes the advanced experience of western countries on the purchase of services. Second,it analyses the typical cases of the purchase of services in China. Finally, it concludes the problemsof legal regulation in the domestic practice from the perspective of economic law.The fourth part is the legal regulation of the purchase of service. It thinks in the system designbased on the combination of theoretical assessment and practical analysis. It designs a whole set of legal system to improve the purchase of services, concluding the government responsibility, marketregulation and social benefits, combined with the internal legal structure.
