Under the rapid development of the domestic market economy, advertising hasbeen popular in our life, and especially noticeable in some new residential quarters.Billboards on the roof, wall adverting, external advertising light boxes and videoadvertising in elevators in residential quarters are increasingly favored by companies.Revenues from advertising have been hotspot discussed by people. However, little ownersin these residential quarters receive revenues from such advertising in reality, whichresults in conflicts between owners and property management companies. This paper willfocus on the ownership and distribution of revenues from advertising on the roof orexternal wall, in elevators or in any other public space or on public facilities in residentialquarters. It will interpret related provisions in the current property law to perfectadministrative regulations such as property management rules. Meanwhile, it willimprove owners’ legal awareness and encourage them to reasonably utilize their right onsupervising the property management and distribution of public revenues of theseresidential quarters, which not only protects the rights of owners and reduces conflictsand disputes rising hereby, but also is favorable for harmonious development of the socialenvironment. This paper will make analysis mainly from four aspects: I. to vividlydescribe basic problems on advertising in residential quarters in respect of concept,character and nature; II. to present and summarize the current status of revenues fromadvertising through field investigation, providing different viewpoints from the academiccircle and readers; III. to vividly set forth loopholes in the lagging property managementregulations of China in terms of ownership and distribution of revenues from advertisingin residential quarters by making reference to regulations on revenues from advertising inresidential quarters in overseas developed countries; IV. to research how to standardizeand improve legal regulations on revenues from advertising.
