In recent years, with the rapid development of information technology, online shoppinghas gradually entered people’s life. As the new product of The Times, because of its speed andconvenience, transparency of price, openness of information and other significant advantages,it becomes more and more popular with people, especially the young. The online shoppinggroup increases year by year, and the sum of online transactions is rapidly on the increase.However, due to the virtual characteristics of online environment, online shopping brings notonly convenience to consumers, but also new challenges of consumers’ rights and interestsprotection in China. So, how to protect the consumers’ rights and interests to the maximumextent in the online shopping environment is very important.This thesis takes "taobao oversold" as the breakthrough point, which analyzes the presentonline shopping situation of the protection of consumers’ rights and interests to get problems,and combines with the experience of abroad online shopping consumer rights and interestsprotection legislation to put forward countermeasures and suggestions.The thesis is divided into four parts. The first part is on the one hand, distinguish onlineshopping from traditional shopping through the online shopping and the definition of onlineconsumers, etc; and lay a foundation for the thesis after. On the other hand, identify thecurrent situation of the online shopping consumer rights protection in China through theanalysis of cases.The second part discusses the problems existing in the protection of the rights andinterests of consumers in online shopping in three stages, that is,the problems existing in theprocess of trading and the problems existing in the default termination cases and problems indispute processing. Fraud problems in the process of trading, mainly the online consumer right of privacy and right to know the other format terms and payment security issues are alsoa lot of troubles. The difficulty in default termination cases mainly lies in the return of theclaims. Evidence issues in the dispute processing, the subject of responsibility anddetermination of the jurisdiction remain difficult problemsThe third part enumerates the online work shopping consumer rights and interestsprotection legislation of the European Union, the United States, Japan, South Korea, so as tofind the perfection of consumer rights protection in the online shopping of China.The fourth part mainly focus on the questions raised in the second part and the advancedforeign legislation and the situation of our country listed in the third part to putforward countermeasures and suggestions to perfect China’s online shopping consumer rightsand interests protection system. Through the trading process, the default termination cases andthe three stages in the process of dispute to put forward the corresponding solutioncountermeasures, making it perfect and protect online consumers’ legal rights and interestsbetter.
