Research On The Legal Protection Of The Rights And Interests Of Consumers Online Shopping

With the development and popularization of science and technology, people’s life change rapidly, Internet technology as the representative of information technology has been integrated into the daily life of the people, on the basis of the Internet online shopping has been accepted by consumers for its fast, convenient advantage, and quickly occupied the consumer market of our country. However, along with the network shopping to consumers convenient, affordable, consumer shopping increased risk, be good to avoid these risks, to better protect the legitimate interests of consumers shopping online, and to promote the healthy, harmonious development of network economy, we must start from the particularity of online shopping to develop more perfect management system standard network trading behavior. To protect the interests of consumers in online shopping process as the research object, analysis of current situation of China’s current network shopping, and then discusses the various violations that occurred in the online shopping process, combined with the domestic and international relevant legislation and practice, and ultimately the online shopping consumer protection measures and suggestions, in order to to realize the healthy development of the network economy. This paper is divided into four parts:First, an overview of the network shopping consumer rights and interests. The network shopping concept to define, distinguish its connotation, and then by the comparison of network shopping and e-commerce, online shopping and traditional shopping, summed up the characteristics of the network shopping and network consumer, and combined with the practice, summed up the current violations of online shopping consumer behavior.Secondly, focuses on the analysis of the network shopping consumer protection legislation present situation and main problems. According to China’s online shopping consumer rights protection and summed up the legislative review, grasp of China’s legislative situation at this stage, the reason analysis of the main problems exist in our legislation and problems.Again, summarized the USA, Germany, EU legislation experience online shopping in the consumer protection, on this basis with the objective reality of our legislation, to further improve the legislative system of our country and lay a solid foundation.Finally, aiming at the actual our legitimate rights and interests of consumers shopping network infringed, recommendations, countermeasures of legal protection of rights and interests of consumers online shopping in China include: improve the online shopping consumer rights and interests protection of the relevant laws and regulations; establish and improve the network shopping credit mechanism; regulate the network shopping related behavior and responsibility; improve the online shopping payment relief system; government departments to strengthen supervision of network shopping.
