There is the same birthplace in Mainland China and Taiwan and the Teachers’ law of Taiwan may be close to the actual of Mainland China in terms of the education. The communication of the Cross-straits is beneficial to both sides in the aspect of culture. Adhering to the traditional education law of the republic of China, educational legal system of Taiwan is very complete, the content is very detailed and it is easier to be carried out. It is advanced in many aspects compared with Mainland China. So it has worth to be reference. Therefore, I made a comparison with the Teachers’ Law between Taiwan and Mainland China in aspects of the history background, the framework and the main contents, comparing the differences and analyzing the advantages and disadvantages. On the basis of this study, proposing some reasonable suggestions on the improvement of the Teachers’ Law of Mainland China.Firstly, the paper is started from historical aspect of the Teachers’ Law of the Cross-straits so as to elaborate the political structure, social structure and legislation system background of Teachers’ Law between mainland China and Taiwan. Meanwhile this paper make a concrete analysis on the legislation significance of the Teachers’Law of the Cross-straits.Secondly, this part is to introduce the framework and the main contents of the the Teachers’Law of the Cross-straits, making readers have a general knowledge of the legal structure, chapter themes and specific provisions of Teachers’Law between Taiwan and Mainland China. It is helped to deepen the understanding of this paper.Thirdly, the comparison of the Teachers’Law of the Cross-straits can be divided into three part. This part is stated from the legal structure aspect of the Teachers’ Law of the Cross-straits so as to compares the differences. A followed-up comparative study is made on the legal status of teachers, the management system of teachers, teachers’ rights and obligations, the treatment of teachers, teacher’s training, teachers’ appealing system and the different parts between the Teachers’ Law of Mainland China and Taiwan. As a result of the comparative study, it can be conclude that there are some differences between the Teachers’Law of mainland China and Taiwan in seven above-mentioned perspective. Then, I made a comparison with the Teachers’Law between Taiwan and Mainland China from the evaluation, concluding the basic characteristics of the Teachers’Law of Taiwan and the existing imperfections of Teachers’Law of Mainland China.Lastly, this paper makes a thorough contrastive study of architecture and the specific provisions of the Teachers’ laws of the Cross-straits. Consequently, from that comparison, the aims and principles of legislation, the characteristics of the Teachers’ law in Taiwan and some rational suggestions are made so as to make some effort to the perfection of the Teachers’ Law in mainland China.The constructing achievement of the Teachers’ laws in Taiwan are brilliance and the legislation system is perfect. Therefore, it has many valuable points that we can learn. In order to promote the continuous progress of teachers legislative construction with Chinese characteristics, Mainland China need to adhere to the reality and combine with the successful experience.
