Protecting children from sexual assaults is always a pressing problem to be tackled with in China’s criminal law. As a result of the changing concept of sex, improvements are needed in terms of some stipulations in the present criminal law protecting children from sexual assaults, viewed from the current perspective of sex in the society. However, children’s rights in Taiwan are soundly protected because the scope of subjects of crime and victims in Taiwan is much more extensive than that in China ’s Mainland. Moreover, crime means have been concretely listed in Taiwan’s criminal law according to different crimes. These are what we can learn from it.The dissertation, focusing on a case tried by the High Court of Taiwan in Taizhong City, analyses the part relating to sexual assaults. Then, it pays attention to the legal regulations on sexual assaults against children and compares the definitions of the crime in Taiwan and China ’s Mainland respectively so as to provide some suggestions for improving the definition of sexual assaults against children in China ’s Mainland. |
