On The Constitutional Guarantees The Right To Health

The right to health is a basic human right, which main body is not confined to a country’s citizens, but applies to all human beings. Different countries have various situations in fulfilling its obligations to the right to health protection. The right to health has yet to be raised to the constitutional level in our country to become a fundamental right of citizens, so it does not have the function and effect of constitutional right and its protection is not enough. This article thinks that we should provide constitutional protection for the right to health to obtain confirmation of the constitution. Life quality theory, natural law, constitutional rights, these three big functions are the important theoretical basis of constitution to health safeguard and national life, age requirements, basic rights system, the perfection of law and fulfilling the needs of the international obligations and constitution are the important reasons of the health right. Make the right to health become the constitutional right is only the first step, it is important to make countries undertake corresponding obligations; whether the country overtake an obligation, respect for the right to health, implementation and protection is vital. Formulating unified health law, solving the related legal limitations, and carrying out the protection obligation of administrative organs and judicial organs, play a very important role for the realization of the right to health.
