In recent years, it has become a urgent problem to solve to guarantee and improve the livelihood of the people with the reform deepening. In the Seventeenth Congress of the Communist Party of China,The people’s livelihood was not only playeded in the height of governing and rejuvenating but also was written in the report of The Seventeenth Congress of the Communist Party of China. In the Eighteenth Congress of the Communist Party of China,it was solemnly promise to make people’s lives better. China has entered the time that accelerat the social construction of people’s liveshood,which state clearly that States need to pay more attention to people’s livelihood and safeguard the people’s livelihood. The state has formulated some policies and take a variety of measures on people’s livelihood In order to guarantee and improve people’s livelihood. But there are still many problems of people’s livelihood in China which not only affects the social stability and development but also adversely affect construction of our country harmonious society. To solve the livelihood problem is an urgent problem faced by our country. It needs various means countries to solve these problems concerning people’s livelihood. The legal protection of people’s livelihood rights is an effective way. In other words, the law is the basic means to solve people’s livelihood. Therefore, legal protection of people’s livelihood in China is a real question worth exploring.This thesis consists of introduction, text, conclusion and other components.The introduction part mainly discusses these questions including the significance of the study of China’s current legal protection about people’s livelihood, research status at home and abroad, the research ideas and methods,key points and innovation research.The main body includes three parts.The first part mainly analysis the connotation and necessity of the legal protection of the people’s livelihood. In this part, the paper defines the concept of civil legal protection. Legal protection of people’s livelihood is that countries resolve people’s livelihood issues closely related with the survival and development through legal means. It includes not only standardizing and restricting government departments according to law power to make its due diligence,but also safeguarding the people’s livelihood rights according to law. The paper points out the necessity of the legal protection of the people’s livelihood:Legal protection of people’s livelihood is the urgent need to solve livelihood problems; Legal protection of people’s livelihood is the implementation of the strategy of ruling the country by law; Legal protection of people’s livelihood is conducive to maintaining social stability.The second part mainly research on analysis of the status quo of legal protection of China’s people’s livelihood. In this part, achievements of legal protection of people’s livehood are summarized, then points out the main problems existing in the legal protection of the people’s livelihood. Firstly, the people’s livelihood legislative system is not perfect and the law is lacking in some livelihood areas.Secondly, the law enforcement environment is not good and the law enforcement is not in place.Thirdly, the judicial system about people’s livehood is not convenient and the people’s livelihood rights relief mechanism is not perfect. Based on these question, The reasons of these question about legal protection of people’s livelihood are revealed. The reasons include the following aspects:"People-oriented" and the fairness and justice of the concept of the rule of law remains to be perfect; The level of socio-economic development constraints; Paying attention to the practice of economic construction,but the construction of people’s livelihood is despise.In the third part,countermeasures are put forward to improve legal protection of people’s livehood. Aiming at all kinds of problems existing in legal protection of people’s livelihood, countermeasures are put forward. Firstly, the new concept of civil legal protection should be established,such as the concept of people-oriented, the concept of the rule of law about fairness and justice,and so on. Secondly, Legislation of people’s livehood should be perfect in order to construct guarantee legal system of people’s livelihood. To this end, we must do the following:In order to guarantee the people’s livelihood legislative democracy and science, the legislative process must have the extensive participation of the public; We need not only improve people’s livelihood and existing relevant laws continiously, but also to strengthen the people’s livelihood special legislation.Thirdly, We should strengthen law enforcement to create a good environment for the people’s livelihood. This need to do the following:To transform government functions and enhance the sense of responsibility and services; To regulate the administrative power operation and ensure the law of people’s livelihood strictly enforced;To improve the administrative enforcement mode and perfect the law enforcement supervision system. Fourthly, we should Construct the justice of people’s livelihood in order to establish convenient judicial system. Specifically,we should do the following aspects:To learn from foreign experience and create social court; To deepen the reform of the judiciary and to facilitate people’s livelihood rights relief; To play the functions of judicial administration and to provide public services. At last,we should improve the legal supervision mechanism of the livelihood of the people and strengthen supervision.The conclusion part summarizes the whole thesis, and points out that China is gradually entering the times of people’s livelihood. In the times of people’s livelihood, the government should pay more attention on people’s livelihood. Especially in the current people’s livelihood construction period, the government should safeguard the people’s livelihood rights and solve the livelihood problems. Although China has made some achievements in legislation, law enforcement and Justice of the people’s livelihood, but to establish a set of perfect civil legal security system still has a long way to go.
