Study On The Farmers’ Petition And The Protection Of Farmers’Right

There are1.3billion people in China and the largest group is the farmers whichquantity is nearly900million. Chinese agriculture, rural areas and farmers’problemsare the important issues that affect the overall development of China. In this new era,the main issue of the farmers is the problem of the farmers’ rights, but in contemporaryChina, the farmers petition is the main channel for farmers to start and direct theirdemocratic right, to reflect the contradictions and issues. Above all, the party and thegovernment should pay high attention to the problems that epitomized by the farmers’petition, experience and observe the farmers’ lives, resolve the farmers’ conflictspromptly and effectively and protect the farmers’ legitimate rights.This paper is divided into three parts and the first part is an overview of the petitionright and the farmers’ rights, then mainly describes the connotation and the relationshipof the petition right and the farmers’ rights. In academia, there is a debate about “eventhe petition right can be set up as a right or not.” My idea is that the petition right is aright and I argument it by stating the Constitution origins of the petition right and thedemand of the people and the society. The part of the farmers’ rights’ connotationstarted from analyzing the meaning of the words “farmers” and “rights”, and this leadsto the concept of the farmers’ rights and then introduced several important farmers’rights in this paper, including the farmers’ land right, equal right, petition right, life right,health right, personal liberty right and the remuneration right. Starting the relationship between the petition right and the farmers’ rights is mainly to illustrate the importantrole of the farmers’ petition.The second part mainly describes three important issues that the farmers’ petitionepitomized, these issues are about the land, the local government’s delinquent behaviorand some organizations back order the wage to the farmers. Concretely, the first is thefarmers land right, equality right have been violated in the land acquisition; the secondis the farmers’ form and virtual petition right, life right, health right and the liberty rightare trampled to varying degrees in the issues of the local government delinquentbehavior; the third is the farmers’ remuneration right that is lost in the issue which theirwage are back ordered. At last, I profoundly analyzed the causes of the above issues.The third part mainly clarified some suggestion to solve the above issues that onthe basis of the issues’ causes and learning the foreign countries advanced experience.The particle put forward some concrete measures mainly from four aspects, namely:(1)change the traditional concept of stability in handling and petition.(2)we mustsincerely respect the farmers and concern the farmers and support agriculture, ruralareas and the farmers’ development;(3)The government should encourage and help thefarmers to establish some rights protection organization and enhance the farmers’ rightawareness;(4)developing and improving relevant laws and regulations.(5)promotingthe judicial independence and setting up the judicial authority.(6)The governmentshould reform and improve the relevant regimes so that eliminating the problems aboutregimes.
