"Shenyang Urban Rail Transit Construction Management Regulations" Legislative Proposal

Definition of urban rail transit in China national standard "terminologycommonly used in urban public transport" is "usually electric-powered, wheel andrail transport to take a quick general term for a large volume of public transport." Inthe current the level of urbanization continuously advancing, the layout of the citycenter area is highly commercialized, is so intensive, only relying on groundtransportation to complete hundreds of millions population mobility transport dailyhas been stretched, it is difficult to continue, Shenyang, as the largest city innortheast of China, is also facing this problem.The experience of the advanced international city shows that, after reaches acertain level of urbanization, the city can solve the high-speed, large-capacitytransportation needs only by the use of rail transport which can also explore newdevelopment space for urban development. However, due to the long period of railtransit construction, large investment, far-reaching impact on urban development, thebest way to guide the urban rail transit develop healthly, sustainly and rapidly isthrough the rule of law. This paper is a response and a attempt for "Shenyang UrbanRail Transit Construction Management Regulations"——one of the20officialProject legislation of the Shenyang Municipal People’s Congress2013-2017legislative plan.By finishing the advanced legislative experience of brothers cities, investigatingand analysising the urban rail transit situation in Shenyang, starting with thelegislative background, the feasibility and necessity of legislation,then I analysis thestatus and trends of rail transportation legislation, and write the basis and legislativereasons for the draft of the legislative proposal one after another. As a proposed draftpresented from the perspective of scholars, I strive to meet the requirements of the actual needs of the development of rail transportation in Shenyang, not onlyemphasizing its implementation, but also focus on the analysis of some commonissues of domestic rail transport development, such as blindly follow the trend ofreporting metro project, insufficient timeliness planning, shortage of constructionfunds, and lack of comprehensive development. I hope this article can provide somereference to other cities for their Urban Rail Transit development.
