Study The Legal Issues Of Health Care Cooperatives

The co-operative is an autonomous organization, which is established to meet the social, economic needs of its members. Chinese co-oprative movement has indicated that coopetatives has deep-rootedly influenced in china. Cooperative movement begined in the1920s. In the1940s, there were some health care cooperatives which meet the characteristics of modern cooperatives. Then the health care cooperatives begined to flourish. After the period of1949, health care cooperatives were dominated by the government. Until the implementation of the household contract responsibility system, health care cooperatives reappeared based on the social needs of individuals for health care services.The paper studies the concept of health care cooperatives and attributes, which defines clearly the essential attribute of health care cooperatives. It also studies the differences and connections of health care cooperatives and the new rural cooperative medical system to expound health care cooperatives that are an enterprise system. Health care cooperatives are enterprise system in civil society, which is to provide health care services and preventive care and health education. The new rural cooperative medical care system is an social insurance system in rural areas of the country. Health care cooperative system is spontaneously created by the people who has demands for health care service, which is a supplement to the national level of medical assistance.Meanwhile, the paper studies the history of health care cooperative movement, dividing the period of the health care co-ops’ idea generating, the period of the embryonic form of health care co-operatives. In contrast to study the abroad health care cooperatives in the legal system, change the traditional democratic management mechanisms of cooperatives, increase the government’s financial support, increase the ways of financing. These all measures contribute to development of health care cooperatives.
