Research On The Function Of Government In Promoting Law-based Management Of Private Universities

Law-based management of universities is an indispensable part of strategies oflaw-based governance of the country in China. In recent years, the job of managingschool by law has been in the practice of ten years, and the universities have been tryingto be the model school in managing school by law, accumulating some experience,which makes the awareness and competence of law-based management of universitiesobviously enhance. The18thCPC National Congress puts forward promoting law-basedgovernance of the country in an all-around way. The Ministry of Education issued “TheGuidelines of Promoting Law-based Management of Universities “in Nov,2012,Compared to the new situation, the new tasks, the development of education reform andthe new requirements of promoting law-based governance of the country, there is still alot of space to be improved in the job of law-based management of universities.Under the background of law-based management of universities, the importanceshould be attached to the law-based management of private universities, which is anindispensable part of higher education system. It involves the self-management,democratic supervision, which helps to establish new relationship among thegovernment, the universities and the society. The law-based management in privateuniversities needs the support and supervision from the government and in this way,what to supervise and what not to supervise are worth discussing. Based on the “The Guidelines of Promoting Law-based Management ofUniversities”, this article does the deeper discussion about it. With the way of theoryapplying to practice, from the position of the private universities, this article probes thefunction of government in the process of promoting the law-based management ofuniversities.Meanwhile, taking Zhejiang Yuexiu University of Foreign Languages as anexample, this article furthermost discusses the experiences of the government inpromoting the law-based management of universities, and the strategies of promotingthat process, which is of great importance to the institutionalization, normalization,scientization and the sustainable development of private universities.This article consists of six chapters. The first chapter is introduction, introducingthe background, significance, the research status at home and abroad, the research ideas,the research methodologies and the definitions of the essay’s core concepts. The secondchapter analyzes the primary problems about law-based management of universities,and the value of implementation of law-based management of private universities. Inthis part, the writer also talks about the origins, the promoting process, the objectives,contents and the significance. In the third chapter, the writer puts forward the functionalrole of the government in promoting the law-based management of private universities.In the fourth part, the writer analyzes the “absence” and “offside” performance of thefunctional role of government. In the fifth part, the writer takes Yuexiu University ofForeign Languages as an example, summarizing the effective functions and preciousexperiences of the government in promoting the law-based management of privateuniversities. The sixth part explores countermeasures to perfect the law-basemanagement of private universities in the functions of the government.
