Research On The Legal System Of The Regulation Of Medical Insurance Fund For Urban Workers In China

Medical insurance system of the urban employees is an important part in the social security system, and is an important factor to protect the ’basic medical rights of employees as well as to promote economic development and maintain social stability. The medical insurance system of our country has made great achievements after years of reform, which has been set up the basic medical insurance system suitable with the economic and social development at the current level of our country. However, due to the diversity of the insured subject, complex characteristics of fund payment standard of the medical insurance for urban workers, and the existing medical insurance institution has always attached to social insurance, whether from the operation of the legal norms, funds, to information disclosure are not independent, especially the legal system of fund operation and supervision are seriously lacked. All of those lead to misappropriation, abuse and even phenomenon of the corruption fund. In view of this phenomenon, the dissertation uses the relevant theoretical knowledge of sociology, the legislation law, economics law and comparative law, dividing into four parts on the research of the legal system of the regulation of the medical insurance fund for urban workers in China.First:the brief introduction of the research background and significance of the topic, the analysis of the current research situation both at home and abroad, as well as the explanation of the research method and the innovation points.Second:The overview of the legal system of supervision on operation of the medical insurance fund. According to the legal basis of current operation of medical insurance fund supervision both at home and abroad, the dissertation explains the legal principles and social value of thr operation supervision of medical insurance fund.Third:Starting from the legal system of medical insurance fund raising and expenditure of urban workers in China, the dissertation analyses the defects of operation of medical insurance fund for urban workers in the four aspects of legislation, the right relief, information disclosure.Fourth:the dissertation puts forward to improve the legal system of regulation of medical insurance fund for urban workers in China. Firstly, it analyses the condition of the supervision on medical insurance fund operation of urban workers in USA, German, Britain and Japan, and summarizes the enlightenment to our country. Secondly, with regard to the current deficiencies in the aspect of supervision, the dissertation proposes four suggestions to construct the regulation of medical insurance fund for urban workers in china. Lastly, on the basis of the above mentioned, in the five aspects of the establishment of mutual restriction of the relationship between doctors and patients, strengthen the fund budget supervision, improvement of the fund payments, the establishment of an independent supervision institution, and the strengthen judicial supervision, the dissertation puts forward legal countermeasures of the operation and supervision of medical insurance fund for urban workers in china. The dissertation offers some reference for the improvement of the medical and health courses as well as the cause of social security of our country.
