Research On Environmental Responsibility Of The Corporation Under The Low-carbon Economics

Along with the development of social prosperity, the depletion of environmentalresources and the pollution of natural environment are more and more serious in theprocess of industrialization. When the environmental problem is more prominent, thesocial disputes increase gradually, and turn into the disharmonious factors ofharmonious society. In recent years, environmental pollution accidents have oftenburned out, so it concerns to environmental pollution and damage more and more.Such as the enterprise polluting event in Shanxi Fengxiang in2009due to children’sblood disease, the pollution incident of residents’ water by phenolic compounds inJiangsu Yancheng in2010, pollution accident of Zijin sewage tank leakage caused byTing River in Fujian in2011, pollution by Phillips of oil spill caused sea area inserious of840square kilometers in2011, mass incidents by people living in SichuanShifang for fear of molybdenum copper project to bring environmental problems in2012July. At the same month, people in Jiangsu Qidong worried that the JapanesePrince Paper Group paper outfall project impacted on the local environment, so thattens of thousands of citizens gathered demonstrations. The environmental problemsburned out again.At complex environmental issues, the enterprises are stand for the main status inthe social activity, and at the same time are also played as an important role in thearea of environmental protection or pollution. The corporate environmentalresponsibility (referred to CER) is a typical kind of social responsibility, so theyshould also shoulder the important mission of environmental protection consideringthe maximum economic benefits at the same time. This paper is combined with theidea of low-carbon economy, to explore and research responsibility for enterpriseenvironment from the angle of environmental law. From the existing literature, thestudy of CER was flourished in the western countries. Therefore, through the cardingand analysis of the definition of CER in the scope of legal theory, and considering theassociated concept of low carbon economy and Chinese current initiative, it discussesthe relation of CER and the development of low-carbon economy, in order to study on the legal problems which realize the CER for low carbon economy mode as part ofthe theoretical preparation.Then, it analyzes of the causes of the absence of responsibility to environmentfrom the three aspects of enterprise, government and social groups, so as to seek therelevant legal system and measures which is suitable for our enterprise developmentand regional adaptability. Based on the analysis of the low-carbon commitmentsturned into empirical foundation of its legal system in the developed countries, itprovides an important reference for our country to link the low-carbon emissions andthe environmental responsibility of enterprise. At the same time, it introduces ourmodern enterprise how to connect the low-carbon environmental protection into theenterprise’s production mode and management concept on the basis of the existingpolicy and legal system.Finally, based on the analysis of reason of our lack and the successful experienceof the modern enterprise development, it is the suggestions to promote corporateenvironmental responsibility. Firstly, it makes the concept of low-carbon economyinto our environmental legislation, and establishes of enterprise’s carbon tax, carbonemissions trading system and carbon labeling system to encourage enterprise to breakthe original concept of development in the new economic mode for catching thedriving point for the coordinated development of economy and environment.Secondly, it is order to perfect the existing norms, to establish a sound system aboutenvironmental discoursing information and the insurance system for the formation ofthe legal system of corporate environmental responsibility.
