Theory Of The Media Era Judicial Mechanism To Cope With Public Opinion

With the development of we-media era, social discussion through network media made the judicial suffer an unprecedented challenge, especially in the criminal trial, it also makes the relationship between public opinion and judicial becomes more and more subtle and complex. We could say that the media penetrated into people’s lives and changed the traditional way of media communication, but also inevitably affected the judicial activities. Judicial, media and public opinion, however, is the important pillar of the rule of law society, the ultimate foothold of their relationship is to maintain social fairness and justice, to ensure the realization of human rights, to promote the construction of a harmonious socialist society.In the we-media age, how to deal with public opinion, in other word, as for the judicial, how to face the challenge caused by modern net-work media, is the issue that this study focuses on. This study is divided into four parts so as to explore the way to deal with public opinion in we-media era. The first part is the introduction, starting from the purpose, background and significance of the research, this paper reviewed the research situation both home and abroad. And list the adopted research method in this research, as well as the innovation and difficulty of the research. The second part is the main part of the study, it starts from the originality of the we-media age, further discusses the characteristics of the we-media and the media age, the characteristics of public opinion and the challenge aroused by public opinion, this is the main part of the full text The third part is mainly analyze the causes of the challenges, and from the point of current judicial response to public opinion of the present situation, there still exsits defects, such as the comformity between judiciary and people’s mind, and the difficulty in achieving synchronization, etc.The fourth part is to find countermeasures, Starting from the nation’s law authority and the law ruling environment, tries to led the public opinion into the judicial activity in a right way, tries to apply the positive effect of public opinion in media age into the judicial activity.The conclusion of this study is:since the we-media age is an era which public opinion can be expressed randomly, and it is an era with opening information, as a powerful social force, judicial is relatively conservative, which inevitably become the center of the network public opinion as well as the network opinion. And the rapid growth of national economy caused many problems, such as the widening the gap between rich and poor, increasingly serious pollution of the environment and corruption, all these problems have caused widespread unbalanced social psychological, thus become the main psychological root of public crisis events. Public opinion is not only a way for people to participate in political activities, is also a kind of resistance and expression to the lack of political participation in the practical system. So the judicial organs should respond the network public opinion as soon as possible, thus clear the adverse impact.
