The Regulation Dilemma And Resolve Path Of Migrant Workers Legal Aid System

With the growing number of migrant workers and the cases of violating the rights and interests of theirs, migrant workers’ legal aid is being more and more concerned and recognized. The further improvement and perfect of the legal aid system is becoming an important content of building a harmonious society.Migrant workers are a special group which arising with the progress of the society. For surviving and dreams, they leave their hometowns and work in the cities. They have become an important indispensable force for the economic and social development. For various reasons, the survival and development of migrant workers face many difficulties and problems. Most of all are the violation of their rights and interests. And because of economic difficulties and poor legal awareness, it is not easy to protect their rights through legal channels. Thus, legal aids have become the most frequently used during protecting migrant workers rights. In fact, migrant workers have become the main target group of the current legal aid servicesAlthough the legal aid system started late in China, but migrant workers legal aid system has developed rapidly. Since the implementation, it has safeguarded a large number of migrant workers’ rights and interests and also become an important weapon to protect them. However, there are also many problems in actual operation of the legal aid system, such as excessive litigation processes, high cost, difficulty in implementation, etc. All these to some extent have restricted the further development of migrant workers legal aid work.Based on the cases of migrant workers in Nantong City, Jiangsu Province, the author has used literature method, comparative analysis and case analysis to interpret the basic structure of legal aid system and especially focused on analyzing the plight and reasons of the system. And at the end, the author presented ideas and suggestions on how to resolve these problems.
