Based On The New Criminal Implementation Of The Concept Of Urban Community Correction Management

In the modern methods of executive management in punishment, most democratic countries tend to a principle of executive socialization, based on this principle, a new approach of implementation called Community Corrections is emerging, it will be conducive to the government’s public administration, allocation of resources will be more rational and the administrative costs of the penalty execution will be reduce more effective. In other countries, the non-custodial punishment system has been trialed over six decades, a more perfect mode of regulation has been formed in the punishment philosophy and management practices, the effect of community corrections management mode in correcting criminals and education aspects has increased, as a mainstream way of punishment in developed countries, community corrections is growing and developing gradually, and now the numbers of community corrections’s officers is large, the configuration of community corrections is reasonable and the relevant laws and regulations of community corrections has been improved.The costs of law enforcement is lower and the social effects is better,what is illustrate the fact that community corrections is a good example with a promising sentence model.Based on the existing research literature,and by reference to foreign experience in management model of community corrections, while compare several management models in our country, combined with the management practices of Ningbo which city on behalf of the medium city,then we can explore the community corrections management model which can generally adapted in China.According to the study, we can find whether it is administration centralized regulatory of government-led model,cooperation regulatory of government-led model or the social regulation of third party model.There are more or less drawbacks,government may "Offside" or "absence " in the management,and may excessive "rigid" or "flexible".There also has a lot of problems, like does not meet the government work spirit of Eighteenth Third Plenary Session,even can not really realize the social economic value of community corrections. For example,in Ningbo,there are a lot of problems in community corrections management.The most important issue is the position of employees in management team is not stable, the structure of management organization is not reasonable,the assessment system of person related is not perfect,social support boycott by the traditional culture and legal construction can not keep up with the development of practice. About how to improve the community corrections management model of domestic urban, scholars have proposed a series of reform programs,these reform programs show the different performance in feasibility and effectiveness, but none of these is the best method to solve the shortcomings of current system.By analyzing the shortcomings of the current management model, learning advanced foreign experience and ideas of other scholars, I believe that improve the ideal model of community corrections management should focus on three aspects,like the management of community corrections personnel, education and assistance.Firstly, independent administrative agency of community corrections management should be established by the local government, it responsible for overall coordination and management of administrative affairs, and then establish a professional team of urban community corrections managementThis team should including three categories,like law enforcement officers,community workers and community volunteers. The team through the improvement of community corrections evaluation mechanisms and responsible for correction and transformation of Criminal.At the last,correction assistance system should be establish, play a important role in social participation,through non-administrative method to solve the problem of community correction officers assistance, and help them integrate into society as soon as possible. Through the above methods, establish community corrections management model which include management, education and helping functions can reduce recidivism rate, improve public safety and raise stable level.The problem reflected should be solved at the grass roots,and resolve the contradiction in political,social and legal effect.
