Studies Of China Coast Guard Enforcement Procedures

In today’s growing marine economy,development and utilization of coastal countries around the world,more and more attention to the protection of maritime rights and marine resources.Establishing a sound scientific and reasonable legal order has become the consensus of the marine world.All maritime countries actively building their marine management system,especially administrative law enforcement system. Our country is a maritime country,but still not a maritime power country.Now we have made on our strategic goal of building maritime power. The management of marine areas will rise to the height of the national strategy. With most of the reform in our country,maritime activities from the original dispersion enforcement to uniform.The fishery,customs,maritime surveillance and border police have integrated into a unified subject of law enforcement---China Coast Guard,who is leadered by China oceanic and receive Ministry of Public Security’s operational guidance.This finishes the situation of dispersion enforcement.Strengthing the protection of marine areas of development is inseparable from the legal system.However,in the management of our marine laws and regulations are not many,and low-level legislation.In which legislative program for maritime law enforcement is lacking. There is no uniform Administrative Procedures Code in our country.Enforcement procedures provisions are scattered in various single law,which is affected by our country’s long heavy entity light procedure law thought.Administrative procedure is the guarantee of substantive law,which has the value and function of independent.In law enforcement activities,strict law enforcement procedures can protect the legitimate rights of the administrative counterpart and prevent the abuse of law enforcement power.Because of the special enforcement areas,the law enforcement procedures has much effected in maritime enforcement’s result.Although our country has integrated the subject of enforcement,the relevant laws and regulations are still used previously dispersed separate legislation departments law enforcement.By comparing the provisions of relevant law enforcement procedures,this paper want to propose the idea of China Coast Guard on enforcement procedures.
