Research On Maritime Law Enforcement Cooperation Following The New Foundation Of China Coast Guard

China has more than 3 million square kilometers of sea area.With the rapid development of Marine economy,disputes and disputes between China and neighboring countries on maritime rights and interests continue to ferment,so it is urgent to safeguard maritime rights and interests.After the 18th national congress of the People’s Republic of China,the state council implemented the reform of the Marine management system,forming a new pattern of national Marine management in which the Maritime Coastguard Agency and the Maritime Safety Administration coexist.At present,maritime joint law enforcement is the main way of China’s maritime law enforcement forces.For a long time,law enforcement cooperation will be the bottleneck to improve the efficiency of China’s maritime law enforcement.So far,various maritime rights protection forces have shown their own characteristics and focuses in the actual operation process,and there are also some problems such as overlapping responsibilities.Therefore,the distribution pattern and responsibility division of China’s existing maritime rights protection force still cannot calmly deal with the complex situation of maritime rights protection and law enforcement,which requires further integration.Therefore,promoting the integration of maritime law enforcement forces is an inevitable trend for China to greatly improve its maritime rights protection capability and better protect its maritime territory and resources.Although China is a major maritime country,there are still problems in maritime law enforcement,such as separation of government,overlapping responsibilities and decentralization of power,which are not suitable for the realization of China’s goals of building a maritime power and implementing the south China sea strategy.At present,the Marine police bureau has not finished the integration,and the maritime and Marine police still proceed from their respective duties,and there is still a gap between the construction of a capable,efficient and authoritative maritime law enforcement team.Therefore,it is of great significance for China to establish a maritime power and implement the south China sea strategy to make clear the division of legal authorization and responsibilities,scientifically distinguish management rights and enforcement rights,actively promote the unification of Maritime Coastguard Agency and the Maritime Safety Administration,and build a law enforcement department responsible for most maritime management affairs.
