Research On China's Maritime Law Enforcement

With the deployment of maritime power strategy,China's attention to maritime rights and interests has reached an unprecedented height.In recent years,China has had frequent maritime territorial disputes with neighboring countries,and maritime terrorism,illegal immigration,smuggling,drug trafficking and other non-traditional security threats have occurred frequently,posing great challenges to China's maritime security.In order to safeguard China's maritime sovereignty and security and strengthen maritime law enforcement,the China coast guard was re-established in 2013 and transferred to the armed police force in 2018.Maritime law enforcement is the act of law enforcement subjects to manage illegal and criminal activities in the sea areas under their jurisdiction as authorized by law.China's maritime law enforcement achievements are encouraging.At the legislative level,China's maritime legislation has gone through a development process from nothing to nothing,from more to less,from single to comprehensive,and has made important contributions to standardizing maritime law enforcement.In the law enforcement team construction level,our country has experienced from the coastal patrol,maritime law enforcement power,fishery,customs,maritime wulong put to sea,to the police to China sea,to the transference of the development of armed police forces,straighten out the relationship between the Marine law enforcement,has realized the separation of the maritime law enforcement decision-making power and executive power,regulate the behavior of maritime law enforcement,improve the law enforcement environment,further maintenance of maritime rights and interests of our country.But insufficient exist in maritime law enforcement in China,on the legal basis,lack of ocean basic law,maritime law enforcement procedure law and relevant laws and regulations,the law enforcement main body,the integration is not completely,China sea police and other law enforcement at sea power purview division is not clear,on the supervision mechanism,supervision method and single direction,supervision and content is not comprehensive,scientific system of supervision mechanism has not been formed,on law enforcement cooperation,maritime law enforcement cooperation areas remain unclear,less cooperation field of law enforcement,the mechanism is not clear.To solve these problems,we should formulate and coastal ocean basic law and Chinese law,perfect the relevant legislation,law enforcement at sea to strengthen coordination,laws and regulations to further integrate China sea police department and improve the mechanisms for coordinating maritime law enforcement,establishmaritime law enforcement and supervision mechanism,set up enforcement authority,to promote the communication of international maritime law enforcement cooperation,expand areas of cooperation and cooperation,achieve win-win cooperation parties,etc,to further improve,in order to better regulate law enforcement at sea,maintaining the maritime rights and interests of our country.
