The Protection Of Privacy Under We Media Environment

With the development of the Internet, we media has sprung up everywhere, which is a third type of spread terminal relative to traditional media and new media, and weibo, wechat, and blog, etc. are the main representatives. These new modes of transmission puts more emphasis on the interaction of information, making the right of speech return to the hands of grassroots people and no longer concentrate within various newspapers and news media. As a result, the public audible threshold has been greatly lowered, on the basis of which public enthusiasm of participating in community life, speaking out their real thoughts, and spreading messages has been greatly ignited, making news come from the public and be able to be attributed to the people as well. But this freedom of expression and dissemination of information apparently exposes massive personal information and views in front of the public when providing us with a broad speech platform, which may cause irreparable spiritual and economic losses. Even the founder of Facebook Mark Zuckerberg once said,"Privacy is gone". Therefore, discussing the issue of privacy protection is absolutely necessary and urgent under the we media environment.This paper is divided into three parts to discuss the issue of privacy protection under we media environment. The first section briefly describes the nature of the we media and the forms and characteristics of the invasion of privacy under the we media environment; the second part takes the provisions by Article36of "Tort Liability Act" as the subject of study, and separately analyses the meanings and shortcomings of privacy protection under the we media environment of the three articles; the third part of this paper proposes detailed and thorough suggestions in allusion to the inadequacies of the law raised above.
