The Constitutional Protection Of The Right To Academic Freedom

The right to academic freedom is that citizen can be engaged in the natural sciences,social sciences and humanities research relying on his own will, without the illegalinterference of others. Citizen have the freedom of teaching、researching、publishing andlearning. The right to academic freedom has both the nature of the positive right and thenegative right. Since the reform and opening in China, the right to academic freedom isgradually accepted by the society. Article47of the Constitution of the People’s Republic ofChina has clear provisions about the right. But, the protection of the right to academicfreedom is far from our goal in the current situation. First of all, we lack the effectiveprotection of the legal system; Secondly, we lack the administrative environment; Thirdly,we lack the unobstructed published way of academic research results; Lastly, we also lackpowerful organization guarantee. The academic freedom is our guarantee of scientificcreation. Only guarantee the academic freedom, can we get the rapid development ofscience and technology and can we have the long-term progress of the society. At the sametime, the degree of academic freedom is the measure of the the degree of civilization of acountry. Therefore, we have the responsibility to safeguard the right to academic freedom.This paper puts forward the following suggestions: Firstly, clarifying the constitutionalstatus of the right to academic freedom, and improving the legal system of relief; Secondly,curbing the improper intervention of public power, and creating a good atmosphere ofacademic freedom; Thirdly, reducing the limitation on the right to publication, and openingthe published way of academic research results; Fourthly, establishing the system ofuniversity autonomy academic administration, and providing organizational guarantee ofacademic freedom; Lastly, improve the system of relief.
