On The Information Disclosure Of The Officials

With the development of the laws of officials’ information and the governmentinformation, alone with the growing of the news media, more people are calling for thedisclosure of official information. Meanwhile, the scope of official information is stillunclear, and the operation of the system has met quite a lot problems. Under suchcircumstance, this article discusses the scope of the official information and makes severalsuggestions.This article includes five chaps. The first chap is about the basic context of theinformation disclosure. Although the scholars are still discussing with this system, there aresome concepts that are confirmed. The disclosure of the officials can help protecting theright to know, enhancing the credibility of our government. At the same time, thedevelopment of this system has met with some obstacles such as the in coordination of theofficials, lacking of supporting and the participation of the citizens.The second chap is about how to determine the scope of the official information. Theofficial information contains four branches: personal information, property information,important items and the position information. The related theories are public interest andthe right to privacy.The third chap is the problems in the practice. We have been working on this projectfor several years and have achieved some progress. But in the practice, the way ofdisclosure restricts the scope of the official information. And the violation of rights alwaysexists.The last two chaps are the conclusion. The disclosure of official information shouldobey the principle of balancing of interest, principle of proportionality, the principle ofcountry security, the principle of agreement and the public places.
