On Rights Of Criminal Victims In China

Based on national conditions, the thesis begins with the revised version of criminal litigation law in2012, and discusses the basic principles and current situation of rights of criminal victims in china. Also, in compare with, and learning from the helpful experiences of different legal systems in foreign countries, the paper further talks about transplantation of law, expecting to be useful for the perfection of legal system in safeguarding fundamental rights of criminal victim in China. As a whole, the topic will be discussed in the following four parts:In the first part, basic principles on rights of criminal victim are presented. In the foundation of reasonable definition of criminal victim, the status of criminal victim in litigation is analyzed in detail in the concept of "social position decides rights".In the second part, the current situation of criminal victims in china is discussed in the basis of the revised version of national criminal litigation law in2012. The rights of criminal victims are further analyzed in accreditation, investigation, prosecution, recitation and execution respectively. After that, a rational thinking is given to the actuality of rights of criminal victim in china.In the third part, the rights of criminal victims are discussed in detail. It begins with the comparison on rights of criminal victims in developed countries in which some enlightenments are got to perfect the corresponding legal system in our country. Then, from the multi-angle analysis in criminology, victim ology and proceeding law and so on, proper rights of victims are classified into rights of participation, relief, defense and assurance.In the last part, specific measures are proposed to promote legal system of protecting the rights of criminal victims. Based on the national condition, the paper gives an overall thinking and concrete thoughts on the perfection of current legal system for rights of criminal victims, from the macro-level and micro-level respectively.
