The Study On Countermeasures To Effectively Protect Seafarers’Rights And Interests In The Maritime Public Service

Seafarers are the core resources in the development of shipping industry, the basic safeguard of maritime navigation safety as well as the basic elements of the labor relations. The improvement of seafarers’rights and interests safeguard mechanism and the active safeguarding of their rights and interests are the basis and guarantee of our country’s transformation into a shipping power and a powerful seafarer-providing country, which will strengthen the professional pride of Chinese seafarers, facilitate the stability and development of seafarers, particularly the officers who are in bad need, and are the concrete measures to practice the scientific outlook on development. The International Maritime Labor Convention,2006entered into force on August20,2013.The measures to effectively implement the international conventions to protect the legitimate rights and interests of seafarers are referred to the agenda of the state and industry management department.This thesis, from the perspective of maritime public services in particular, carries out thorough research and analysis of the Maritime Labour Convention2006and the laws, regulations and rules of China which are concerned with the provisions of safeguarding seafarers’rights and interests, combines the theories of service-oriented government in our country, the construction of "four type maritime", public services, the spirits and requirements for constructing a service-oriented government with scientific functions, optimized structure, honesty and high efficiency and the people’s satisfaction, and demonstrates the necessity and significance to protect the rights and interests of seafarers.This thesis studies and analyzes the legal requirements home and abroad in respect of seafarer rights and interests protection, the status quo of maritime public service as well as the major tasks and overall goal in protecting seafarers’rights and interests, draws lessons from the United States, Hong Kong and other maritime administration authorities at home and abroad on their advanced experience of seafarer rights and interests protection, further analyzes the existing problems of the maritime administration authorities in protecting the rights and interests of Chinese seafarers, puts forward the countermeasures and suggestions as the urgent task, short-term goal and long-term goal on the scientific and effective protection of seafarers’rights and interests in China’s maritime public service.
