As the primary part of the administration, administrative decision-making directlyreflects the scientific level of a country’s administrative law. Recently, China vigorouslypromotes the development of the legal system. Combing with this background, thispaper analyzed by examples, to compare from both positive and negative aspects. UsingBeijing Metro Transit recently rising in the price of the decision-making process as thepositive cases and the case of the city of Phoenix charging incident to produce resultsas negative examples, with reference to other cases as a secondary argument, wesummed up the administrative decision-making process legalization remarkableachievements made in the development process, including the level of attention fromthe legal issues administrative decision-making process, emphasis on publicparticipation, highlighting the democratic and institutional innovation, such as the timelimit. For there are still problems, from various parts of the administrativedecision-making process in all aspects of preparation, review, protection and so on, weproposed rationalized, scientific, feasible suggestions for legalization and strived toachieve as soon as possible legalization of administrative decision-making process.
