Higher Education Disputes And Vexatious Suit Settlement Mechanism

With continuous deepening of education reform and the promoting of legalizationprocess, university students pay more attention to the importance of their own rightsand interests. In the meantime, education disputes increase sharply with newcharacteristics. This article, by way of quality and quantity research, such asquestionnaire, interview, case analysis material research, aims at the status, newcharacteristics and solution about the present issue, that is, deputes betweenuniversities and students education, in order to understand its causes and solvingproblem.Furthermore, the article, combining with the existing research results, analyzes thecause and difficult position of the special phenomenon "vexatious suit of the currentcollege education disputes. Guided by relevant theories, the article presents opinionsabout perfecting the existing educational disputes settlement mechanism and certainconnective measures for the internal and external education disputes resolutionmechanism, and discussing the mechanism of a recognized third-party organization,which using Alternative Dispute Resolution (ADR) to solves these deputes as well.The study, by means of reviewing the particularity of university education andshortage of the existing dispute settlement mechanism, is conducive to the availablesettlement mechanism. The study eventually builds up an education disputesprocessing mechanism in ADR way, which helps to enrich educational managementtheory, promote the healthy development of the education and maintain the stabilityand harmony of the school and society.
