Research On Dispute Inside Resolutional Mechanism Of Students In Colleges

In recent years,disputes between colleges and students emerge one after another.Due to the lack of effective solutions,there are more and more cases which end up going to court.Following the “Disturbance in hospitals",the “Disturbance in school" have begun to attract the attention of the society and the public.There are many reasons for “Disturbance in school ",one of which is the lack of disputes inside resolutions.In view of the particularity of disputes between colleges and students,the traditional administrative reconsideration and litigation methods have their defects and are not the best choice.Therefore,the latest "Regulations on the Administration of Students in Ordinary Colleges and Universities"(referred to as the "Regulations")stipulates that colleges and universities should establish Dispute Resolution Institutions and designs corresponding procedures.However,due to various reasons,the work in this area is progressing slowly at present.Based on the above background article,this research attempts to combine the previous relevant studying and analyze the dispute resolution of college students with the background of L high vocational school.It also tries to set up an operable dispute resolution process that conforms to the procedural rules for my college by referring to the characteristics of various dispute resolution methods in our country.The article is divided into five parts.The first part mainly expounds the background and significance of this research.The innovation of this research lies in exploring the preventive intervention measures for disputes between college and students,adding an analysis of psychological factors for disputes and trying to refine the specific process of the student appeal committee,so that colleges and universities can really apply these solutions in practice.The second part mainly describes the current situation of disputes in colleges and universities from three aspects: types of disputes,solutions and difficulties.The third part is to take L high vocational school where the author works as a case to analyze the causes of disputes among college students and the measures currently taken by L high vocational school to reduce or avoid disputes.Through the form of questionnaire survey to understand the views of students on university management,students' right to appeal,dispute solving methods,etc.The fourth part is the theoretical analysis of disputes,including the analysis of the legal relationship between colleges and students and the basic discussion of the settlement mechanism,which lays the foundation for the final mechanism construction.The fifth part is the focus of this article.Through the analysis of three forms of John Rawls' procedural justice,it analyzes the dispute settlement mechanism of college students from three aspects: prevention,and in-school to explore the feasibility of the campus jury system and put forward specific ideas,hoping to provide reference for the inside dispute settlement of college students at present.
