To construct of modern university system with Chinese characteristics is the key of higher education system reform. But building charter of university is the main part of modern university system construct in China. In2010, the National Long-term Education Reform and Development Plan(2010-2020) was published, in this file have gave clear guidance recommendations about construction of charter of university, such as "each types of colleges and universities should develop charter under the law and manager school with it","to establish and improve charter with the provisions of law and reflect their own characteristics" and etc. All of this have illustrated the importance of construction of university’s charter. This research is to pay attention and to solved the "Fact" and "Ought" two states of establish charter in public universities of China with the jurisprudence perspective.The first chapter of introduction section will describe the relevant background knowledge and literature research of university charter construction. The second chapter have located the legal status of public universities firstly, and then to develop legal principle analysis of charter of university with legal nature, legal status. Legal effect, the basis subject and program of develop. The third chapter do research on ontology with charter of ten public universities, analysis of the current status of charter of our public universities, including the subject of developing is not clear, non-standard setting process, the content of development imperfect and other problems, following analysis the legal principle reason of these problems, including the uncertainty of the legal statue of public universities, the status and effectiveness of charter of university is uncertainty, the regulations of charter is not based on comprehensive and etc. The fourth chapter is to solve these problems which above with the knowledge of jurisprudence to give some legal recommendations from the establishment of a sound legal system of charter in public universities and develop the Promotion Law of Charter Developing in Public University. To regulate the formulation of charter in public universities and move forward the scientific of out country in construction of charter by public university.
