The Enactment Of China University Statute Based On The Public Governance

The construction of modern university system has been an evolutive direction and inevitable trend of China higher education reform. China modern university system should be founded based on the idea of the public governance, regulating scientifically the interrelation and action manner among every power subject between university and government, university and society, and inside the university. This needs not only the legalization through the laws and regulations of government, but also the standardization through the rules and regulations of school. It is an important route to advance deeply the reform of China higher education that we make university statute with the characteristic of Chinese scientifically by taking the theory of public governance as the basic idea.This thesis is divided into 5 chapters. Chapter 1 puts forward the thinking of research, the methods of research, and some possible innovation on the basis of analyzing the background and meaning of the selected title, reviewing the research results about university statutes and modern university system. Chapter 2 analyzes the main problems that China universities are facing at present and the reasons for these problems at first, then proposes the basic thinking of university governance which is we should set up the system of modern university to perfect the university governance by taking the enactment of university statute as a basic route, and taking the theory of public governance as a basic idea. Then, this chapter carries on discussion and analysis of the current situation and the existing problems of enactment of China university statute. Chapter 3 compares and analyzes the basic contents of several university statutes of chosen domestic and international universities. And it analyzes mostly the relevant regulations of the relation among every right subject between university and government, university and society, and inside university regulated by the statutes of domestic and international university. Then it summarizes the general methods in which university statute is made and their enlightenment. Chapter 4 analyzes the basic idea and the value orientation that we should insist on during the enactment of China university statute. Chapter 5 proposes the suggestion of the basic frame of China university statute on the basis of the analysis of the special problems that should be dealt with and the property of China university statutes that should be identified while enacting China university statute. The thesis's research on China university statute based on the theory of public governance makes the arising research on university statute move from analyzing the pure theory towards combining the theory with practice. And at the same time, it makes the enactment of university statute move from the formulation of simple text towards a good route to realize university governance, thus have a realistic significance further.
