In this paper, the small property right house is a construction above the rural collective land.The sale or rental of housing is to non-members of the collective organization.Since the reform and opening up, China’s comprehensive national strength has been increased and constantly enhances the ever-accelerating process of urbanization, with the city expanding urban and rural land use pattern has undergone significant changes. In recent years, the land resources are becoming scarce. Real estate prices continued to rise in large and medium cities and formed a situation where small property right house is developed and constructed under the name of villages inside cities reconstructed, towns and villages merged and the new rural construction and showed a continuous trend of the spread. The problems of small property right houses have become increasingly prominent. Although the state authorities have repeatedly issued documents to prohibit urban residents to rural areas to buy small property right houses, small property right houses flourish across the country because of its price advantage. The survival of the small property right house has been the focus of attention of government, media, academics, developers and the general public.This paper is based on land property rights theory, rent premium theory, supplying and demands theory about land as the theoretical foundation with literature method、comparison method and summary method, on the basis of analysis of previous studies, summarized the present situation and problems of the small property right house in Wuhan City and Analyzed the reasons of its emergence then found that the reasons of emergence of the small property right house are institutional deep-seated reasons and the incentive on the supply and demand. On the path to solve the problems of small property right house, the practice and exploration of other local governments were analyzied, and the experience was summed up. Finally, combining the actual situation of the Wuhan city, the author proposed the solution path to deal with the stock of small property house and inhibit the development of small property house in Wuhan city. This article is divided into the following five parts to the study:The first part is the introduction which described the background, purpose and significance of research, domestic and foreign research status,(he main contents, methods and technology roadmap. The second part is about the related concept and theoretical basis. The third part analyzed the characteristics、problems and their causes of the small property right house in Wuhan City. The fourth part analyzed the practice and exploration of other local governments in solving the problems of small property right house in Wuhan City. The fifth part explained the solution path about the problems of small property right house in Wuhan City. Finally, the main work of this paper is summarized, and raised the lack of research and directions for future research.
