With the development of intellectual property rights beyond one country, heinternational transactions related to intellectual property rights are more than ever,thus, a more closely relationship between international trade and intellectual propertyrights has been an obviously feature. Since1990’s intellectual economy has got ahuge step among industrialized countries, which promote the development ofeconomic globalization and trade liberalization to a further standard, and thereforefollows much revolutionary changes in many fields. Intellectual property rights arenot only an important element influencing the technical improvement and economicdevelopment for the nation, but also reflect its trading features in their internationalprotect nature. After the world entered into a new century, with the economic rise ofthe Third World countries, the number of cases about infringement of intellectualproperty rights is increasing, the major developed countries of the world is starting toestablish f a previous personality on intellectual property protection the Ordinance ofagreement-ACTA is born in such an environment, for which would be bettermaintain of the country’s intellectual property rights and protect their legitimateinterests,This paper based on these clues, has4branches to introduce ACTA’sestablishment how to affect China’s foreign trade. The first chapter introductionACTA basic situation, including ACTA meaning, characteristics, courses ofdevelopment and contrast between ACTA and existed TRIPS and other detailedthings of the Anti-Counterfeiting Trade Agreement. The body of the second chapter isto introduce our major trading partner countries’ views of ACTA, which helps us havea preliminary understanding of how the impact of China’s foreign trade in the nextempirical analysis of the ACTA. The following chapter of is the core of this paperwhich through establishment of a model, empirical analysis the establishment ofACTA how to influence China’s foreign trade. This chapter mainly has four aspects,first expounded the theoretical basis of the protection of intellectual property rightsand the development of international trade, followed by a brief introduction of themodel—Gravity Model of Trade, and finally described the data need to use in thisarticle and thus utilize eviews6.0analysis the above data by regression and get the results. The finally chapter of the body, given for the above-mentioned introductionand discusses of the article suggest what countermeasures our country should be takenand measures put forward in the future development of foreign trade. The main focusof this paper is to begin with the government to improve the legislation, in order toprovide a better protection of intellectual property rights platform for the enterprise;second to strengthen the co-operation with the Third World Country to boycott ACTA;third to draw on the valuable experience of the development of intellectual propertyfrom Western countries, which better to develop our own intellectual property;Finally, starting from businesses and individuals, strengthen the research andprotection of intellectual property, raise awareness of intellectual property protectionfor enterprises and individuals.
