The world economy changes from the industrial economy with labor and capital as the center to the innovation economy that combined innovation and creative. On the basis of intellectual property,the rapid development of innovation economy is an essential condition of the rapid economic growth of the two countries. Intellectual property theft often occur,such as. But the increase of counterfeit goods the market of increases, the wide-spread monopoly core technology of the industry. Along with the rapid development of technology and the increase of the globalization of technology trade scale, the technical trade friction has increased day by day. Then the difference of the protective system of intellectual property rights become the focus. Especially with the growth of international trade, the merchandise trade of counterfeit product that infringed intellectual property right also showed a trend of growth. Thus the spread of counterfeit product brought a lot of damage to the international trade market.The type and the market of the intellectual property right infringement has been diversified. First, in order to stop the infringement of intellectual property rights, It’s the most effective way to protect in the import and export stage.The trade related intellectual property rights agreement of WTO(TRIPs) is on the provision of the specific conditions of border measures, the provisions of the relevant customs clearance, is on the purpose of intellectual property protection in the import and export stage. So before the trade transactions, the customs protection of intellectual property rights has a very important role.Due to the two different legal system and social culture and so on, the protection range of the customs clearance items, customs retention measures and guarantee in the areas of intellectual property rights have a lot of difference. So the conflicts of intellectual property rights protection often occur.To have a more detailed understanding on both sides of the intellectual property rights and the provisions of the customs clearance, put forward the most suitable protection of intellectual property rights system, which can make the trade between the two countries more smooth, this is what the purpose of this study.This paper puts forward problems and improvement measures between protective system of intellectual property rights in China and South Korea customs. This paper will develop specific argument for the following four points. First, the research on the international protection of intellectual property rights system and the world trend of intellectual property protection. Second, the research on system of customs protection of intellectual property in China and South Korea. Third, the research on the difference between protective system of intellectual property rights in China and South Korea customs. Finally, aimed at the problem of China and South Korea protective system of intellectual property rights, this paper will consider some perfect countermeasures and put forward some constructive views.The introduction of WTO, heralds of the opened era with infinite competition. The fierce competition of the technology development, the copying of its technology in competitors, infringement problems among countries is also increasing. The goods that infringement of intellectual property rights, once in circulation, will cause irreparable damage to owners. So the customs protection of intellectual property rights has a very important role in the future.This paper will put forward two suggestions to the two governments. First, regular exchange of service between two countries. Second, set up a system that can exchange information in time. I hope the paper can help the development of Chinese border measures and the trade between the two countries.
