Technological progress is the internal driving force to promote the long-term development of acountry’s economy, there are two main ways to improve the technical level, independent innovation ofdomestic and absorption of international technology spillovers. As developing countries are subject torestrictions on the level of innovation, and any technology have different degrees of spillovers, imitationand learning of foreign advanced technology has become the main ways for developing countries toimprove the overall technical level of the domestic and promote economic development. As the maininstitutional factors to affect the technology spillover, intellectual property protection will directly affectdeveloping countries through foreign direct investment and import trade channels to introduce advancedtechnology and the learning behavior, and ultimately affect the absorption technology spillovereconomic effects.In this paper, a review of relevant literature based on the status analysis and the empirical analysisof China’s protection of intellectual property rights on the economic effects of absorption ofinternational technology spillovers. In the part of status analysis the article reviews the developmentprocess of China’s reform and opening up30years of intellectual property protection system fromlegislation to law enforcement to learn more about the current level of protection of intellectual propertyprotection system. Followed by reviewing the characteristics of China’s utilization of foreign directinvestment and imports in the course of development and distribution in the country of origin as well asthe current two channels, product structure analysis China receive both channels of internationaltechnology spillovers on the domestic economy the impact of the development, and also provide arealistic basis for the empirical analysis. In the part of empirical analysis the article use the1990-2010national level time-series data, estimated by unit root test, Granger causality test and the method ofleast squares effects of each variable on attracting foreign direct investment and import trade channelstechnology spillover economic effects.The results of this study are:(1) China has reached the level of developed countries in theprotection of intellectual property rights legislation, but the status analysis shows that China’s currentintellectual property law enforcement is weak, resulting in the overall level of protection is still low.(2)the impact of domestic R&D stock of technological progress in China is not significant. It is becausethat China’s companies lack of internal autonomy R&D investment and innovation capabilities. But thecombination of the intellectual property protection system as a whole to promote the role oftechnological progress significantly, but the effect is small.(3) China’s current intellectual propertyprotection strength is in stage of promoting both FDI channels and import trade channels technologyeconomic effect. Strengthen the protection of intellectual property rights could be further enhancedChina’s absorption technology spillover from FDI and import channel so as to enhance the overalltechnical level of China.
