The traditional forms of circulation can’t meet theneed of the changes, like interchange, subcontracting, assignment, joint stockcooperative system, etc. Also the spontaneous formation of circulation has somedeficiency and insufficiency in actual operation. For this reason, creating new formof circulation becomes an important task in country economy development. To keepthe circulation in good order, the trusteeship is bought into the process to form newkind of land trust circulation suiting for China’s national conditions. The new formand traditional forms will form a diverse and marketized circulation system bycompleting each others’ advantages. Land trust circulation is a process withoutchanging the basic land proprietorship. Farmers dispose of their managerialauthority to trust institution and get paid. And those scattered lands will be rent outto agricultural corporations or other fund organizations. Thus the land resourceswould be in effective utilization as expected.The trust mechanism of circulation on the right of contractual management onthe rural land only remains in the theory stratification, and it has been carried outonly in very few places all over our nation. By the systematical research on thetheories, from the perceptive of the the current development of China’s rural landtrust,the characteristics and effect analysis of it, and combining with the related casesabout the land trust models in the place of Shaoxing in Zhejiang province andYiyang in Hunan province in China, this article will make an analysis of theoperating mechanism concerning the trust circulation of rural land, and identify theshortcomings and defects from the existing system, so as to find measures forimprovement correspondingly, and we also should make constructions of theproperty right structure, governance mechanism, risk control and supervisionmechanism, and etc, combining theory with practice, and then provide the feasiblemodels for the land transfer and the referenced suggestions for government in itsmanagement and guidance of the land transfer.
