Study On The Structure And Partners Selection Of The Patent Alliance

Patent alliance has multiple values for enterprises. It refers to an alliance which is basedon common strategic significance between enterprises and is connected by a group of relativetechnologies. Within the alliance, businesses can achieve patent cross-licensing or use eachother’s patents with a discount. They can also release joint statements to the outside.Emergence of patents marks a significant change in the field of patent competition. Withpatent pool, patent competition has changed from tactical competitions characterized by asingle patent to strategic competitions characterized by patent portfolio. According to someadvanced experience of foreign enterprises, patent pool has already become a weapon incompetitions of IPR(intellectual property rights), particularly in the new and high technologyarea. As rapid and successful promotion of its development and application, significance ofpatent pool is increasingly be reflected.Having consulted a large amount of relevant materials and based on investigation andinterviewing, this paper chiefly focuses the topics on establishment of patent pool anddiscussing the problem of partner selection. Leading by the theories of strategic alliance andpartner selection, also using analytic hierarchy process, we studied in depth on theoreticalanalysis, behavioral description, index system design, construction and the use of evaluationmodel. Including:First, to recognize the theory of patent alliance is the logical starting point of this study.In this paper, we studied patent thicket, tragedy of the anti-commons and cross license of thepatents. And we also define the meaning, types and characteristics of the patent alliance.Besides, we analyzed the composition of the patents in the patent pool in depth. Enterpriseswho form patent alliance is economically motivated. And the demand of the patents is thedirect driving force. The enterprises in the patent pool form the patent alliance in order toachieve the optimization and integration of enterprise resource. And they pursue theadvantages complementary to each other to achieve greater competitiveness.Second, key part of the dissertation is analysis on constructing process of patent alliance.Based on the analysts on the cause of interior and exterior relations of construction of patentpool, this paper provides the dynamic mechanism of patent pool’s building. Analysis ofconstruction of patent alliance consists of two parts: patent choice and partner selection.Meanwhile, this text has done in-depth research on construction of patent pool as follows:studies on characteristics, advantages and disadvantages, goals, missions and case analysis.This thorough research is about three modes of management of patent pool and they are patent alliance alone, association, all control under the third party.Third, partner selection index system design is the key in patent alliance cooperativeimplementation. Following the "theoretical analysis, expert advice; questionnaire survey,statistical analysis; convergence adjustments, and gradually perfect" target design ideas, wedesign index system of seed industry in patent alliance cooperative implementation. Fromunderstanding towards patent alliance and its structure, we design four theoretical indexsystem which include patent value, fundamental strength, trusty and external environment.Indicators of patent include degree of innovation and maturity, application, remaining periodof protection and dependence degree on intellectual rights. Fundamental strength includesresources, the research ability, corporate reputation and alliance experiences. Credibilitydegree should be evaluated from funds credit, performance and punishment mechanism.Agency and policy guidance are included in indicators of business’s external environment. Itis just those14indicators mentioned above which is included in the index system of partnerselecting.Fourth, partner fuzzy comprehensive evaluation in patent alliance cooperativeimplementation is the ultimate goal of this study. We use AHP to determine weights, the fuzzycomprehensive evaluation method to evaluate Low-Carbon Lighting&Technology Co., Ltdin Dongguan. By doing this we provide a case to the application of the scoring method ofpartner selecting.Fifth, research on the measures our country can take brings the dissertation realisticsignificance. This section covers three sides: the government, enterprises and patent alliance.In the study on the construction of patent pool, partner selecting theory is introduced andthe author looks at partner selecting from the business’s part of view. At the same time, theauthor uses a more scientific method called the fuzzy mathematical models. The above can beseen as innovative points in this article.
