Economic Analysis Of The Impact Of International Trade On The Patent Infringement

With the risen of integration of the world economy and the development of trade, the world paid much more attention to patent infringement issues in international trade. The attitude of every country in the foreign trade of patent protection and infringement issues are:sensitive, complex and varied. Infringement issue involves not only the individual interests of the trade body, but also it will impact the social public interests and other aspect of the countries in trade, therefore, based on the requirement of trade security, governments and international organizations should to weigh all aspects of infringement in trades. There is no unified punitive measure to treat the infringement issues in foreign trade among all countries, and developing and developed countries stand in their own respective positions, the severity of the punishment of infringement are different from the legislative and judicial. From general merchandise patent infringement to the patent battles in the field of science and technology in international trade shows the increasing importance of the patent. Especially, after China’s join to the WTO, the rapid increase in the volume of international trade, trade friction brought by patent issues are continue increase. So how to deal with the impact of infringement in international trade has gradually risen into our vision, and the government and many scholars are concerning with this issue.In this paper, the research object is the impact of patent infringement on internation al trades, tried to analyze the affect of patent infringement on import and export countrie s and the individual actors involved in the trade by the trade theory and the method of ec onomics analysis. This paper introduced the welfare economics and evolutionary game t heory, analyzed the impact on social welfare of the import and export nations through th e mathematical formulation of derivation. Again, analyzed the stable equilibrium selecti on and prevention strategies of different economic agents in importing and exporting co untries by evolutionary game theory. Tried to find some ways to resolve the infringemen t issues in complex trade relations by studying the economics standardization. The resea rch aim of this paper:firstly, from the national level, analysis the impact of infringement on the nation welfare of both trade countries. From the individual perspective of partici pants, analyzed the impact of infringement on the participants, and analyze their strategi c selection in front of infringement. Secondly, implemented the policy individually and comprehensive management from the aspect of national and individual, and proposed m y strategy and institutional suggestions to deal with the patent infringement in the intern ational trade, to make our country to be a powerful country of patent instead of big coun try of patent.
