Property management is a new service industry along with the development of socialeconomy and housing reform in China. After more than30years developing since the firstinland property management enterprise was set up in1981, property management has beenbooming from coastal areas to inland,from east to west and from first-tier cities to second andthird-tier cities. It is spreading all over and its employees are expanding continually. Now,property management has made gratifying achievements. However,there are many problemsarising, for instance,incomplete law and regulations, limited scales of property managementcompanies,non-standard management,lack of service items and professional talents,insufficient qualified staff,the imbalance of regional development,remaining problems by thereal estate developers, low establishing rate of proprietors organizations and proprietorcommittees,non-standard operations, poor industry image,complaints,frequent disputesamong proprietors, property management enterprises and real estate developers. Theseproblems restrict the healthy development of property industry,and also hinders socialstability and construction of a harmonious society. Both external restricts and internal factorsin the enterprises proper account for these problems. In recent years, the high complaint ratiohas become a hot social concern.With the help of literature review, case analysis, using empirical analysis and normativeanalysis, the thesis adopts the questionnaire method to analyze the situation of propertymanagement disputes in Xi’an, and compares it with the international advanced managementexperience, studies the causes of disputes of property management here, and exploressolutions to the problems. It is of certain theoretical and practical significance.The thesis consists of four parts. In the introduction, the background of the study, itspurpose and significance are described. The study of property management and itsachievements at home and abroad are briefly introduced. In this part, the basic ideas andresearch methods of the thesis are also explained.In the second part---“basic theory of property management”, it introduces theconcept, characteristics of property management, and illustrates concerning theory of propertymanagement as the modern property right theory, the principal-agent theory, the main content of condominium ownership theory, and discusses the application of these theories inproperty management.In the third part---"the types of property management disputes and analysis of disputecauses in Xi’an", by comparing with the advanced experience in property management athome and abroad, the thesis analyzes the situation of property management in Xi’an, itsmajor problems, the subjects of disputes, the focuses of the disputes. Combining with actualcases, the author analyzes the reasons of disputes from seven factors, including propertycompanies, the proprietors, real estate developers, industry management, socialfactors, solution systems of disputes and other reasons.In the fourth part----"suggested countermeasures for the disputes of propertymanagement”, the author proposes corresponding suggestions for property managementcompanies, proprietors, real estate developers, industry management, public opinions anddisputes coordinating organizations respectively.
