In the process of accelerating the transformation of economic development mode andstrengthening the rule of law about China, the field of labor relation has been given moreand more attention. With the establishment and development of market economy in ourcountry, labor conflicts and some social problems have intensify occurred in recentyears. Old labor contract law cannot adapt to the development and changes of the currentlabor relations already, its defects and deficiencies has exposed increasingly, so the newlabor law came into being. However controversy appeared before the implementation ofnew labor law, scholars have different voice about its effect on the economic developmentof China. Export trade has become an important driver of economic growth in China sincereform and opening up, a lot of empirical evidence confirms that export trade not onlyeffectively promote the overall economic growth and regional economic development inour country, but also in the domestic enterprise technological progress and productivityplays an important role.This article from the perspective of theoretical and empirical analyzed the impact ofthe new labor law on the export of our country industrial enterprise. New trade theorypoints out that the economies of scale is one of the most important factors that affect theexport performance, economies of scale for export driven not only embodies in marketcapacity, more mainly reflects the cost advantage in the scale of the enterprise itself hasformed. In addition, the endogenous economic growth theory point out that, human capitais one of the key elements of promoting the technological progress,human capital cancreate new technologies or enhance the ability of digestion, absorption, distribution andapplication of existing technology to boost productivity growth. The provisions of the newlabor law, increased the enterprise labor costs, reduced the employment scale, weaken thecomparative advantage of cheap labor in China and raised the export price of the product,thus reduced the enterprise’s products export competitiveness. Empirical aspect, this articlethrough the country’s industrial enterprise data of31provinces from2005to2011toanalyze and obtain the new labor law’s impact on exports. In controlling the variableswhich influence on the characteristics of the enterprises to export, namely: assetslogarithmic, liabilities logarithm, operating expenses, profit logarithm, through OLS testand random effects test, the results show that the new labor law of the coefficient isnegative, but the negative relationship between the new labor law and the logarithm of the export value was not significant, the reason may be because the new labor law negativecontribution to export, while the relationship between the rest of the control variables andthe export value of logarithmic is still significant.
