Abstract/Summary:
In recent years, as one of the most feasible approach against excessive emissions of carbon dioxide, "carbon capture and storage(CCS)" has been introduced to many countries and regions. For developed countries, not only this new technology was adopted successfully,but some related legal systems were also launched simultaneously. Although CCS has been introduced to China, it is still at an early stage, especially in terms of the development of related legal systems; As a result, the process of both commercialization and large-scalization of the CCS technology were impeded significantly. Therefore, this paper will focus on how to establish appropriate systematic frameworks of legislation to provide solid institutional base for CCS’s diffusion and further development in China.In this paper, the CCS project undertaken by Shenhua CO., Ltd will be examined as a case-study. Firstly, both the theoretical framework and category of CCS technology will be introduced; Secondly, by analyzing the status quo of CCS’s development and the necessity &feasibility of further promotion of CCS technology in China, a series of potential legal deficiencies related to CCS will be discussed in-depth. These deficiencies include legislation absence, chaotic regulatory standards, insufficient public involvement, the limited access to finance, poor risk management measurements and so forth. Finally, the comparisons between China and other Developed countries will be conducted, in order to figure out possible solutions and feasible approaches to promote the further development of CCS-related legal systems in China.
