Study On The Legal Issues Of Rural Household Waste Management In Shaanxi Province

The reform and opening up policy has witnessed the steady growth of the economy in Shaanxi Province.The rapid development of economy has greatly changed and improved the consumption concept and purchasing ability of farmers in our province.At the same time,a large amount of rural household waste is produced.However,traditional waste disposal treatment methods are not suitable for this kind of household disposal increase.Therefore,the problem of rural environment triggered by rural household waste becomes more and more serious,and it inevitably affects the construction of "beautiful countryside" in our country.This article uses tow methods: empirical analysis and normative analysis.Through the objective analysis of the current situation of rural household garbage in our province,we must understand its existing problems.The legal issues of the pollution of rural household waste in our province will be investigated through the analyses of the terms and implementation of the regulations of rural household waste disposal.In this part,this paper will propose a detailed description of the national and local laws,from which we can see that the government is concerning about the law of rural household waste treatment from the national level.This is reflected in the many aspects including basic principles,the division of government responsibility,the promotion for environmental protection for the public,and so on.At the local level,the laws on the treatment of rural household waste are gradually refined,which can be reflected in the environmental protection regulations,independent laws and the responsibilities of thelocal government.And the implementation of laws and regulations is explained respectively from the positive and negative aspects.Shaanxi Province has made good progress in the implementation of these laws and regulations,for the basic environmental protection goals are realized and the environmental protection funds are in effective operation.The existing problems in legislation,law enforcement,compliance and legal supervision are also analyzed in this section.Operations of the waste treatment laws from Japan,the United States,Germany will be introduced in the next chapter for adding experiences for us to learn from.And there will hopefully be more approaches for the rural household treatment.the author puts forward legal countermeasures targeting at legal issues of rural household waste treatment in Shaanxi Province.To solve the legal problems of the rural living garbage in our province,we put forward legal countermeasures from four aspects: legislation,law enforcement,law compliance and legal supervision.Legislation should begin with changing concepts,perfecting the legislative system,and legislation that targets rural garbage.Law enforcement mainly focuses on the construction of rural environmental protection teams,the legal responsibility of strict governance,and the exclusion of local protectionist and GDPist interference.The law-abiding aspect is mainly to expand the publicity channels and improve the legal system in order to ensure that the government supports and supports rural household waste management.Legal supervision emphasizes that strengthening the leadership of the government to take the lead,promoting social organizations and groups to supervise and deepen the peasants' sense of ownership aims to strengthen self-monitoring awareness.
