Research On Legal Issues Of Waste Management Under PPP Mode

The problem of urban waste management is becoming more and more serious,rural waste management is not optimistic,and the PPP mode has great potential in waste management.However,compared with other types of projects,garbage management under PPP mode has its particularity,and there are many legal problems.In order to better promote the practical operation of waste management projects under the PPP mode,promote waste management,improve the living environment in my country,reduce the risk of environmental pollution,and further enrich the relevant theories of waste management under the PPP mode.Based on the actual situation of waste management projects under PPP mode and the frontier of relevant theoretical research,the article makes an in-depth study on the legal issues related to waste management under PPP mode by using literature analysis,statistical analysis,case analysis,comparative analysis and other research methods.According to the study,the dispute resolution mechanism of waste management under the PPP mode are controversial,the right of government intervention in waste management under the PPP model is less restrictive,the legal regulation of waste management under the PPP mode is not stable,and the waste management franchise agreement under the PPP mode is confused with the PPP project contract.The reason why there are such legal problems in waste management under the PPP model,this is mainly due to the controversial legal nature of waste management project contract under PPP mode,unclear content of government intervention right for waste management under PPP mode,low legal hierarchy of documents related to waste management legal regulation under PPP mode,and insufficient understanding of waste management franchise agreement and project contract under PPP mode.It is suggested to clarify the contract nature and dispute resolution mechanism of waste management projects under PPP mode,strictly regulate the exercise of government intervention right under PPP mode,improve the legal regulation of waste management under PPP mode and connect it with environmental protection law,and strictly distinguish the franchise agreement and project contract of waste management under PPP mode.
