With its important contribution as one of the “foundational industries”, food industry play serves an important role in the national economy system. The emergence of food additives has boosted the development of modern industry and invigorated its food sector the food industry once again. In order to bring the industry sector to a healthy virtuous circle, the government has launched a series of laws, procedures and practical measures to regulate the market of food additives. However, due to both interior and exterior reasons, the market currently remains problematic and food addictive abuse has been widely observed in this industry. Recognizing this,an analysis regarding legal issues of food addictive abuse is of great importance to the country today.The thesis consists of five parts: Chapter I: Introduction. This part is primarily an outline of the thesis including the significance of the topic, literature review, methodologies and innovative value of the thesis.Chapter II: Literature review of related notions. The first part will present a general idea of international legal definition of food additives as well as its functionality and use policy. The second part differentiates legal and illegal additive usage, and thus, to establish and categorize illegal usage, food addictive abuse.Chapter III: Legal analysis of the status of food additive abuse in China. This chapter will analyze the abuse from three different perspectives: legislation system, enforcement mechanism and company level self-regulation. Through analysis of real cases of food additive’s industrial practice abroad, the author would like to find out existing problems of China’s current system, and thus to reach the conclusion of a general summary of the primary problems: decentralized enforcement system, establishment of labeling system, and unregulated use policy. As for the cases of enforcement system, there is a vagueness of duties, inefficiency, incomplete system and insufficient material & management support. Let alone under the circumstances of poor company self-regulation.Chapter IV: The fourth part elaborates the extraterritorial of the use of food additives.Through revisions of provisions of the versions of International Commission, Canadian and European Union on legal usage of food additives, the author would like to conclude a practice system of legislation enforcement and self-regulation.Chapter V: Suggestions of anti-food addictive abuse of China. The chapter serves as a corresponding sector of Chapter III and IV, which provides suggestions regarding different motivations of abuse including standardized labeling system, and improvement of relevant standards, enhancement of risk assessment system, centralization of law enforcement system,resource optimization & support in the field of detection method and improvement of self-regulation.
