With the development of the construction industry, more and more people recognize the risks management play an important role in construction projects. Especially after the earthquake of Wenchuan occurred, the risk caused by force majeure raises people to think the risk management of construction. In building the project implementation process, the owner and the contractor relies mainly on "Construction Contract(model text)" to clarify the rights and obligations of the contract, but in the "Construction Contract(model text)", for the conditions of the force majeure did not give a clear definition, just do a rough generalization, so that when the force majeure occurred, which brought losses to the project. The parties recognize that due to force majeure is not uniform and cannot reasonably shared responsibility, and ultimately lead to a contract dispute.From the 2013 edition of "Construction Contract(model text)", the thesis introduces the concept of force majeure and the consequences of force majeure and detailed description of the principle of shared responsibility. Then stand contractor’s point of view, adhere to the principles of fairness and justice, manage the risk which is brought about by force majeure. Use Probability and Statistics and extreme value analysis method to calculate the probability of the earthquake which has different magnitude in Hebei Province and the surrounding areas. And use the principle of small probability event to make relatively, which express condition of force majeure as earthquakes, to provide the theoretical basis of the earthquake risk shared responsibility for the contractor. Definite the risk which will be should bear by the contractor, help the contractors do risk management, reduce contract dispute with the owners, as well as to improve the "Construction Contract(model text)" to provide a reference.
