Research On The Regulation Of C2C E - Commerce By County - Level Administration For Industry And Commerce

The development of the Internet has brought a huge change to the traditional industry, and the electronic commerce that is based on the internet is an important revolution to the traditional sales model. This paper has pointed out that the electronic commerce is the general item of how people are engaged in commercial activities through the Internet, but according to our law, those applying electronic communication or digital information means are not included. C2C means Consumer to Consumer, referring to the trading pattern in which consumers can trade through the internet. Typical C2C mode stands for the way in which small or medium-sized sellers sell their goods or provide service through the internet. According to the statistical data of "the development of Chinese e-commerce companies’report-2013", C2C accounts for absolute dominance in the network of retail shopping, it takes up70%or more in the proportion of online retail shopping. C2C e-commerce is developing rapidly and has the advantages that the traditional marketing model never have, but with the development of C2C e-commerce, the government has also ushered in a variety of new management problems. Such as unfair network competition, false advertisement, trademark infringement and illegal behaviors, these illegal behaviors seriously affected the healthy development of C2C e-commerce market, and they made it difficult to safeguard consumers’ legal rights. To a certain extent, they affected the healthy operation of national economy and the construction of harmonious society. Administrative department for industry and commerce at the county level is the basic regulatory power, the "network transaction management method" says that the administrative department for industry and commerce at the county level has the responsibility of promoting the development of network trade, regulating the behavior of network transactions, protecting the legal rights and interests of consumers, investigating and punishing the illegal behavior, etc. As a national civil servants working in the field of industry and commerce administration at the grass-roots level, the author has carried on the investigation and analysis of the current situation of yizheng administrative department for industry and commerce’s control of C2C e-commerce and has found there must be some problems. The author analyzes the cause of these problems and tries to find out the reasons and to think about some strategies or measures of solving those problems. By learning from the advanced idea and experience, local business practice and exploration of supervision work, the author hopes to drive the comprehensive work of the regional regulation of C2C e-commerce, and to give some experience to other administrative department for industry and commerce at the county level.This thesis is divided into five parts:The first part introduces the research’s background and significance, and defines the relevant concepts, puts forward the researching methods, ideas and technology roadmap of this thesis. The second part is to summarize the administrative department for industry and commerce at the county level and the C2C e-commerce regulation, together with the theoretical basis and the necessity of the C2C e-commerce regulation, as well as the administrative department for industry and commerce’s function and role on the C2C e-commerce regulation, also is to analyze the necessity and feasibility of monitoring C2C e-commerce market. The third part mainly puts forward the current situation and existing problems of administrative department for industry and commerce’s control of C2C e-commerce. The fourth part puts forward the causes of C2C e-commerce regulatory problems. Finally, in the fifth part, some measures are put forward to solve the remaining problems.
