Automobile has entered ordinary Chinese families; problems existing in the automobile industry are closely related to ordinary people. It is easy to buy a car but difficult to own a car, Because of the high cost of car repairs. The reason why the cost of repairing a car is so high is because of monopoly. The most prominent problem of auto parts sales is a variety of vertical monopoly. Unlike horizontal monopoly agreements can apply directly itself illegal principle, the vertical monopoly agreements often requires a combination of different factors to decide, often with concealment. But, the damage of the longitudinal price monopoly to the interests of the consumers is obvious, especially in auto parts sales industry. For the auto industry regulation of the "Administration of Automobile Brand Sales Implementing Procedures" have a series of problems, not suitable for the development trend of the current automobile industry gradually. The anti-monopoly law in China has regulated the vertical agreements. However, the article is too abstract and difficult to be used in practice. Paper combines the "antitrust law","Administration of Automobile Brand Sales Implementing Procedures" relevant provision, in other countries for vertical monopoly regulation, at the same time combined with other countries, the essay discusses the regulation of the auto industry. Not only pay attention to in the process of analysis theory, and combining with our country automobile industry defining the specific situation, it analyzes a series of vertical monopoly problems in China’s auto parts sales, and combined with my professional knowledge regulation opinions and Suggestions are put forward. We should develop the rule of the vertical agreements in China from the types, the assessment criterion and legal responsibility on the foundation of the experience of European countries and U. S. A.The paper divided into four parts, chapter one is an overview of auto parts market, expounds the composition of the auto parts sales market in China, the development environment and a series of problems. Chapter two analysis the automotive vertical monopoly in our country basis on vertical monopoly theory, including state the illegal principle and the principle of rationality. It also analyze the manifestation of vertical monopoly and state the cause of formation. The third chapter mainly analyzes the present status of the auto parts sales of vertical monopoly regulation in China, including foreign system of regulation, and the "Administration of Automobile Brand Sales Implementing Procedures " and "antitrust law", and analyzes the relationship between the industrial policy and competition policy. The fourth chapter puts forward regulating suggestions for China’s auto parts industry, which combine with the laws and regulations of other countries.
