Research On Incentive Land-protecting System

Since the Land Reform Law of the People’s Republic of China was published in 1950, our country has gradually established regulative land-protecting law system, and it has contributed specially to land-protecting process. However, nowadays the regulative law system has come out as out-of-dated with the frequent phenomenon of desolated rural land and that of peasants abandoning their field. In such circumstance, it is favorable to introduce incentive land-protecting law system, since regulation and incentive are two important means for public management.Within thirty years of Reform and Opening-up, the market has become the main method for resource allocating as the major enforce for economy and society. One lesson from the land-protecting experience of the developed countries is that if one government value land-protecting and endeavor to improve the efficiency of land-protecting, it is more likely for it to apply incentive method. So introducing incentive land-protecting system not only caters for the need of economy-developing, and overcomes the shortcomings of regulative system, but also stir up the peasants’ ’ positive and improve the efficiency of land-protecting. This paper starts from the definition of incentive land-protecting system on the basis of Externality Theory and Public Product Theory, illustrates the rationality and inevitability of incentive land-protecting system and points out the problems of current system via the description of history and present situation, so as to establish incentive land-protecting system stimulating the peasants’ initiative to protect the land to achieve the final goal of protecting the land based on China’s Circumstances.This paper contains four main parts except abstract and conclusion, within 35,000 Chinese Characters.Part One: Definition of the incentive land-protecting system. Starting from the connotation of incentive, this part covers the notion of incentive land-protecting system, and paves the foundation of following discussion.Part Two: Theory basis of incentive land-protecting system. This part introduces the Externality Theory and Public Product Theory and concludes that the reason why law-makers apply incentive in land-protecting lies in the great External Benefits. Moreover, the External Benefits is a kind of public product, and incentive is an important method for government to achieve the Internalization of Externality, the plentiful supply of External Benefits of land, as well as to protect the land.Part Three: Empirical analysis of the history, development and existing problems of the land-protecting system in China. This part illustrates the laws and regulations in the field of land-protecting since our country established, introduces the concrete expression of “regulative land-protecting system” and “incentive land-protecting system” in related policy and regulation, and points out the problems of current system, which show the direction of coming theory-constructing and system-renewing,Part Four: Construction of incentive land-protecting system. This part reviews related system of countries abroad and comes up with the idea of constructing Chinese Agriculture Easement System, improving the Rural Land Property System, and perfecting the Land Use Tax and farm subsidies and establishing incentive land-protecting system based on Chinese Circumstances to achieve the internalization of Externality and protect the land eventually.
