| Water Margin as a classical literature work that reflected social reality profoundly, it exists a phenomenon that some of them can be understood and accepted by the public and illegality. Because the people did not have a particularly clear legal concept, they always understand and deal with problems in the perspective of moral culture and Enyi Arena, and often ignore the law of authority.This paper mainly discusses three major issues: “Contradiction between emotion and lawâ€, “Conflict between righteousness and lawâ€and “Deviation between loyalty and lawâ€.The first chapter “Contradiction between emotion and law†mainly discusses a phenomenon that people involved in law of “Water Margin†violating the law for the maintenance of affection, love, kindness. Such as Wu Song for brother revenge is out of family affection, Yan Poxi has an affair with Zhang San is out of love, and Chao Gai led the people to save Song Jiang in execution ground is out of the kindness of Song Jiang. From the aspect of moral ethics, the behavior of people involved in law can be forgiven, even some behavior has been praised by the general public; but from a legal point of view, the behavior of people involved in law ignored the authority of the law, and had a bad influence.The second chapter “Conflict between righteousness and law†mainly discusses Water Margin heroes in maintaining social justice and brotherhood, fighting against the darkness of the social reality of the relevant phenomena, such as Lu Zhishen boxing killed the town of Kansai for people, Dai Zong attempting to save Song Jiang for brotherhood, Li Kui was reckless upright but committing innumerable murders. From the point of view of the lake culture, heros getting rid of an evil for the people is the behavior of helping and enforcing justice on behalf of Heaven, and is a matter of people clapping and cheering; but from the ruler’s point of view, the act of killing of rebels in Liang Shan is the performance of disregard for human lives and trampling on the law.The third chapter “Deviation between loyalty and law†mainly discusses the loyalty of the National Water Margin Heroes had to make a choice of taking to the bush for social reality. Heroes being harmed by traitor ministers, finding no way to serve the country, and had to take to the bush. However, taking to the bush means to fight against the court and offend the law. Heroes can only seek to the route curve of serving the country and wait to serve the country after taking the forest under the control of the dark decay.Through the analysis of the three kinds of contradictions in Water Margin, to explore the rational factors of heroes in water margin, to deeply analyze the reason why the ancient people’s legal consciousness is weak, and help us to understand the characters and legal phenomena in Water Margin. |
