Labor dispatch system originated in Europe and the United States moredeveloped market economy countries in Twentieth Century twenty or thirty years.Our country labor dispatch is in its early stages of development, because of China’slabor force overall oversupply, see the labor dispatch in promoting employment willplay an increasingly important role. The employer and the employer is the maincharacteristic of the labor dispatch workers is not the same as the main body, the labordispatching work for vulnerable groups of the rights and interests of vulnerable.The main reasons for the lack of labor dispatch of labor laws and regulations ofthe dispatched workers rights and interests have been infringed upon. The presentlabor dispatch legal provisions mainly in the "labor contract law", but due to theprinciple of the rule of law, some irrational and ambiguity of legislation, the labordispatch in the basic law according to the situation. At the same time as the labordispatch is not standard, because of the high cost of rights, have occurred from time totime caused by the dispatched workers rights and interests are violated..In this paper, the protection of the rights and interests of dispatched workersfrom improving our service purpose, through comparative analysis method andsystem analysis method, carries on the preliminary analysis of the protection of rightsand interests of dispatched workers to labor in China and the existing problems,comparison and comment on at the same time, the United States, Japan, Germany andother European countries the labor service dispatch workers rights and interestsprotection provisions or system, puts forward some concrete suggestions to improvethe protection of the rights and interests of dispatched workers of our services. At thepresent stage, our country should improve the legislation of labor dispatch, labordispatch entity admittance threshold, rational division of labor dispatching units andthe responsibility of units, regulate the labor time of dispatched workers and the scope of application, the protection of dispatched workers equal pay for equal work rights,perfect the infringement of dispatched labor rights remedy system, so as to betterprotect the labor the legitimate rights and interests of the dispatched workers, promotethe establishment of harmonious labor relations.
