Research To Chinese Characteristic Proprietor Self-government

The theory and practice of owner autonomy originates in west countries, and spreadsaround the whole world. In1991, it came to China in the wake of the reform andopening-up. Since the first owner autonomous form appeared in Shenzhen, it has beendeveloping for more than20years in China. As a new thing, owner autonomy’sdevelopment is not plain sailing and has a long and rough history in these years. With theconstruction of urban modernization and urbanization and the deepening of housingsystem reform, in addition to the improvement of socialist market economy and citizen’sliving standard, more and more commodity residential areas are mushrooming in China. Itis so clear that the growing trend of owner autonomy being irreversible. Although Chinahas standardized and guided this new autonomous mode from legal institutions andpractical operation since the reform and opening-up, many problems still exist today. Theconsiderable significant issues of how to overcome these problems and difficulties facedby owner autonomy, and how to construct autonomous modes with Chinese characteristicsneed our analysis and exploration.This dissertation elaborates systematically the development stage, development mode,jurisprudential and important vital function of our country’s owner autonomy in accordingto two concepts, owner and owner autonomy. On the base of research to jurisprudentialbasis, features, experience and disadvantages about owner autonomous development inwestern countries, Hong Kong and Taiwan along with owner autonomy’s actualdevelopment condition, at the same time, analyzing the aspects of laws and institutions,system organization, autonomous subject about the problems and shortcomings of ourowner autonomy. We have to explore a kind of autonomous mode with Chinesecharacteristics which suits the situation of china in the perspective of law, institution,subject and experience reference by taking “beautiful garden event” as an example inorder to better serve for the owners, expostulate for the development of democracy at thegrassroots level, contribute to the building of harmonious society. This dissertation notonly provides a living example to study and analyze the theory and practice of ownerautonomy, but also provides a reference to development path and mode of the ownerautonomy with Chinese characteristics.
